This claim refers to the commission percentage charged by major third-party delivery platforms per order.

## Legal Basis for Comparative Advertising (Ireland / EU)

Comparative advertising is permitted under **EU Directive 2006/114/EC** (Misleading and Comparative Advertising Directive), implemented in Ireland, provided:

1. The comparison is not misleading
2. It compares goods/services meeting the same needs or intended for the same purpose
3. It objectively compares material, relevant, **verifiable** and representative features
4. It does not discredit or denigrate trade marks
5. It does not take unfair advantage of the reputation of a trade mark

**"Up to 35%"** is verifiable via the sources above and represents the upper bound of publicly reported rates, making it a defensible claim.

Naming specific competitors (e.g. "Deliveroo charges X%") with a single fixed percentage is riskier because:
- Rates vary per restaurant contract
- The advertiser must be able to verify the specific rate claimed
- A competitor could dispute and require court evidence
